Can A Manager Be Held Liable If He Organizes An After Work Employee Appreciation Event And Someone Gets A Dui?
A friend of mine got a dui after leaving an employee appreciation event held by her manager at a bar where he purchased drinks for everyone. When she left she got a dui. Can her manager be held liable for her dui and should I contact her business and inform them of the conduct of their manager who was s#@*faced?

No, the manager isn’t responsible at all (unless you can prove that he knew she was intoxicated and he still gave her booze anyway; although in that case, it would be the bartender who would be sued as he poured the drinks, not the payer for the drinks). And for starters your friend could have said no to the free drinks, but she didn’t. And your friend could have taken a taxi or a bus home or had someone else drive the car for her. She chose to drink (no one held a gun to her head and forced her, did they?) and she chose to drive…so she alone bears the total responsibility for her criminal act.
Leave it alone. If your friend worked in a right-to-work state, they can fire her for any reason. And even if it wasn’t a right-to-work state, they can fire her for executing poor judgment (ie. drunk driving). There is no possible way that the manager can be held responsible for your friends DUI. If you interfere, you can only make things worse for her (guess what kind of reference she will get if you make things uncomfortable for them). Your friend broke the law and she deserves whatever punishment the courts will give her. Good luck!

No, the manager can’t be held responsible because she has to take personal responsibility for her own actions.
The firing was probably unjust, but if she previously had problems with the manger (which sounds like she did) she should have known that a work event is a work event and to never let your guard down.

of course you can complain to mgmt, but they were all adults. Unless she was chained to a chair and someone was holding her mouth open and pouring drinks down her throat, she has no one else to blame but herself.
what does her being let go have to do with the party?
if she works in an at-will state, she can be terminated anytime for any reason

WITH THAT SAID……….IS IT WORTH IT ????
SHE IS GOING TO SUE HER EMPLOYER AND POSSIBLY LOOSE MONEY AND A POSSIBLE CONTACT WHEN SHE IS LOOKING FOR WORK……….
WHAT IS HER EX………EMPLOYER GOING TO SAY TO THE NEXT EMPLOYER ????
IF I WERE HER……..I WOULD KEEP THIS QUIET AND NEXT TIME WATCH HOW MUCH YOU DRINK AT A PARTY……………….
